Hire Experienced Counsel
Hire counsel who is knowledgeable in the charging decisions made by the Government–whether it is using a grand jury or seeking the filing of an Information.
Hire counsel who is very well versed in the various crimes with which you could be charged and can argue that your conduct should be charged under the least punitive statute.
Hire counsel who understands thoroughly the applicable sentencing guidelines. That counsel can attempt to ameliorate the consequences of the charging decision and attempt to obtain the most successful outcome.
Testify at the Grand Jury or Not?
You may be given the opportunity to appear before a grand jury. This is a very delicate matter and you need sophisticated analysis before you make this decision.
If you are about to be arrested?
Prepare your family for the charging; attempt to arrange surrender with an agreed-upon bond which you can meet. If you need to pledge your home or a family home as security, have all documents and signators available.
Note that if the Government believes that your home or other property is tied into your crime, they may seek a hearing on the source of any funds that you use to secure your bond.
Bondsmen require when writing a Federal Bonds require that you pay them a premium of 15% of the amount of the bond and then secure them with funds or property for the entire amount of the bond.
Your counsel should explain what will take place on the day that you surrender–real stuff such as how long it will take to post bond; can your family see and speak with you after you surrender, etc.–these practical questions should be answered and you and your family can be relieved of one more worry.
